INTELLECTIAL PROPERTY
Potomac Storm Volleyball Club, PSVBC, and the Potomac Storm name, marks, logos, and other insignia are protected through trademark and/or service mark registration and are defined as the intellectual property of Potomac Storm VBC LLC. A user of the Potomac Storm Volleyball Club's intellectual property must have prior written approval of Potomac Storm VBC LLC. Potomac Storm VBC LLC may withdraw approval to use its names, marks, logos, and/or other insignia in its sole discretion. Members shall immediately comply with any notice to cease and desist from the use of the Potomac Storm VBC LLC’s intellectual property or face immediate expulsion from the Potomac Storm Volleyball Club, as well as appropriate legal action.
No person(s) shall create any social media pages or accounts, clothing, or other goods, which utilize the Potomac Storm Volleyball Club name(s), marks, logos, or other insignia, as only authorized Potomac Storm VBC LLC administrators shall create social media pages, websites, and other direct or indirect marketing platforms and/or accounts and only persons authorized by Potomac Storm VBC LLC, in writing, shall serve as primary custodians and administrators of the same. This policy will be strictly enforced. Violations will result in the suspension and/or expulsion, from Potomac Storm, of the offending party.
RELEASE OF LIABILITY and ASSUMPTION OF RISK AGREEMENT
IN CONSIDERATION OF the undersigned being allowed to participate in ANY event and/or activity held by or on any premises owned or leased by FW Properties LLC and/or Potomac Storm VBC LLC (Potomac Storm Volleyball Club), their members, owners, officers, agents, assigns, members directors, employees, volunteers, sponsors, advertisers (hereinafter individually and collectively known as the CLUB), whether such activity is at the Potomac Storm Gym, located at 64 Dupont Road, Martinsburg WV, or at any other facility or address utilized by the CLUB, the undersigned understands and agrees that the risks of injury, illness (including communicable diseases such as MRSA, influenza, and COVID-19), permanent disability and accidental death, to my child/myself/and others from the activities involved in these programs are significant and further agree that I, for myself, my spouse, and child/children:
KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE CLUB, or others, and assume full responsibility for my child’s use of the Club's facility(s) and equipment (whether leased or owned); and,
Willingly agree to comply with the Club’s stated and customary terms and conditions for participation, including the CLUB policy of no refunds of fees paid. If I observe any concern, I will remove my child from the participation and the CLUB's facility immediately; and,
And on behalf of my/our heirs, assigns, personal representatives and next of kin, HEREBY INDEMNIFY, RELEASE, AND HOLD HARMLESS the CLUB, WITH RESPECT TO ANY AND ALL INJURY, ILLNESS, DISABILITY, DEATH, LOSS (including but not limited to any financial loss of any membership fee, facility fee, and/or participation fee paid to the CLUB), OR DAMAGE to person or property, incidental to my child’s involvement or participation in these programs and/or use of the CLUB's facility(s) and/or equipment, WHETHER ARISING FROM THE NEGLIGENCE OF THE CLUB OR OTHERWISE, to the fullest extent permitted by law.
Affirm that I have explained to my child/children/ward: the risks of the activity, their responsibilities for adhering to the directions, rules, and regulations, and that my child/children/ward understands this agreement.
The undersigned, for myself, my spouse, and child/children, affirm that we have read this RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, fully understand it’s terms, and agree to it freely without inducement.

2024/2025 SEASON PSVBC PARENT/PLAYER AGREEMENT
This Agreement is by and between Potomac Storm VBC LLC, a West Virginia limited liability corporation, dba Potomac Storm Volleyball (PSVBC), it's agents, employees, volunteers, officers, directors, and their spouses, hereinafter known as PSVBC, and the person(s) signing below, individually and collectively, together with their children, spouse, heirs, agents, and assigns, regardless of age, to include the masculine and feminine, both singular and plural, hereinafter known as Parents.
THE UNDERSIGNED PARENTS AND PLAYERS AGREE TO THE FOLLOWING:
1. SPORTSMANSHIP
A. Parents & players will always model good sportsmanship by the way they treat all athletes, coaches, officials, administrators and other parents. If the club is fined due to inappropriate actions, as determined by CHRVA, USAV, AAU, and/or PSVBC, of a player, player's parent, player's grandparent, player's guardian, or any other person related to a player, such fine shall be doubled and paid by the parent or guardian of the player. The player shall not participate in practices or tournaments until such time as the amount has been remitted to PSVBC.
B. Parents will be a supportive and positive about their child’s playing experience. They will also support their child's teammates, coaches and parents inside and outside the gym. Parents agree to never post derogatory comments about a player, coach, staff member, competitor, other parent, or PSVBC, on public websites including but not limited to Facebook, Twitter, and Instagram.
C. Parents will always refrain from coaching their child during tournaments or practices/scrimmages.
D. Parents and players agree that not every player will receive equal playing time and that those decisions will be made by the coaches & administration, without input from Parents. Parents & Players agree to support the team at all times.
E. Understanding that infighting can destroy team morale. Parents will encourage their child to resolve any issues on their own before Parents get involved. Parents understand this is part of the player's growth process. When Parents need to communicate concerns to the coaches, Parent understands that it should be done in accordance with the policy outlined herein.
F. Parents who are interested in becoming a coach, referee, or statistician should inform a staff member. The Parent can begin PSVBC training to prepare them for the role.
G. Parents agree that there is a “NO CONTACT for 24 hours” rule following competitive play. Cooler heads are inevitably more productive. Any concerns the parent may have will be addressed AFTER the 24- hour period following the game or tournament.
H. Parents agree to learn the rules of volleyball & assist at some PSVBC tournaments.
2. VOLLEYBALL ATTIRE
A. Proper “volleyball attire” is required for all practices and games. This includes the proper club jersey, spandex (black), knee pads, socks, and volleyball shoes when at tournaments. Practice attire should be an appropriate shirt (including but not limited to any practice shirt), spandex, knee pads, socks, and volleyball shoes. During inclement or colder weather, dress appropriately. No volleyball attire worn to tournaments, practices, and/or scrimmages, shall not have been "home made" or purchased from any source not approved by PSVBC. Manufacturing and or distribution of any intellectual property of PSVBC, shall be considered a SERIOUS violation of this agreement and could result in immediate removal from PSVBC, and forfeiture of all amounts paid to PSVBC, as well as any civil penalties which may result from litigation. Coaches, parents, and players shall not wear clothing to tournaments, scrimmages, practices, or team/club bonding events which indicate/display any volleyball club or team name other than that assigned to the team, by PSVBC. The name of each team is listed on the Offer, made by PSVBC, and will be displayed on the Team's Chat in the PSVBC TeamApp.
As coaches, parents, and players must represent PSVBC in a positive manner, when at team related events. No reference to any other NAME shall be made during team events, which include but are not limited to tournaments, bonding events, scrimmages, and practices.
Parents & Players agree not to wear any clothing/spirit wear that displays the name of any other junior volleyball club and/or team name that is not assigned by PSVBC as doing so would be a reflect negatively on PSVBC, would be a distraction, and could result in removal from practice as well as suspension and/or expulsion from PSVBC.
3. PRACTICES & TOURNAMENTS
A. Attendance at practice is mandatory. Missing practice will impact playing time, with few exceptions. Practices are the foundation of everything we do during games. Expect to practice two days a week for approximately two hours each day. Players are expected to spend additional time practicing on their own. It is the Parents responsibility to inform the Coaches if their daughter will be missing a game or practice.
B. Parents must ensure that their daughter comes to practices and games at the time designated by the coaching staff, is ready to play, and has the proper equipment and uniform.
C. Parents agree, for health reasons, that their daughter will have her own water bottle.
D. Parent's agree that it is the player’s sole responsibility to secure their own belongings, at practices and games.
E. Parents agree that Players must stay in the practice or tournament facility and may not leave the facility without a coach’s permission. If a parent/guardian is leaving their child alone with the coaches, they MUST directly communicate this to each member of their team's coaching staff. No child will be left alone by the coaching staff at any time. Every effort must be made to pick up your child, in a timely manner, after games and practices. More than 3 late pickups (without prior written discussion with the coaching staff) will result in a mandatory discussion, between parents/guardians and PSVBC staff, before the child can resume practices.
F. Parents agree that during tournaments, players are required to “work” and will be responsible for officiating, score-keeping and calling lines. No player is permitted to leave a tournament site until all “work” responsibilities are completed, unless instructed by their coach. PSVBC will provide opportunities for players to become certified in score-keeping and officiating, through opportunities that CHRVA, AAU, JVA, and/or PSVBC provide. Barring prior approval by the coaching staff, should parents/guardians remove their child prior to completion of the player's work assignment, the player will be suspended for 1 practice or sat for 1 set in the next tournament match.
G. While it is the intent of each coach to be fair, it is very important to note “Travel” Volleyball is not “Rec League” Volleyball. Parents agree that equal playing time is not guaranteed. Coaches and statisticians (court cameras will record all practices & scrimmages) have the responsibility of evaluating players during each practice and tournament. If there is a question about playing time, the player is to request a meeting with their coach, said meeting to occur before or after a scheduled practice, & in the presence of an assistant coach.
H. It is PSVBC's intent to teach each player to improve their volleyball skills and volleyball IQ during the season. This will be done during practice. Parents agree that, during games, players will be placed where they will most benefit the team.
I. Parents are prohibited from coaching their children during games. Parents will refrain from undermining or contradicting the coaching staff's instructions.
J. Parents agree that players are expected to be supportive of their teammates on the court and while on the bench. Poor conduct could result in reduced playing time. Players shall not be disruptive or disrespectful to their coaches or team members, in any manner, while playing or practicing. Players who are found to be disruptive or creating any problems among the team, at any time (including on social media), will be counseled by the coach, club director, and/or a member(s) of the Board of Directors. After counseling, if the disruptive behavior continues, the Board of Directors shall reserve the right to dismiss the player from the club indefinitely.
K. Parents agree not to ask coaches about “playing time”. If Parents feel their daughter is not being given opportunities appropriate to their ability, they can discuss the issue with the board member assigned to their team. Parents do not discuss the concerns during tournaments or in front of players. The board of directors will review video with the club statistician and make a determination as to the team's stats and abilities. The directors will discuss the matter with the statistician, club director, & coaches, and then recommend a course of action.
L. Parents and players agree to cheer positively for all players.
M. Parents agree not to enter upon a court, during play, unless their daughter has suffered an injury.
N. Parents agree that player's cell phones are to be put away during practices, unless an exceptional situation requires their daughter to be able to receive a telephone call.
4. COMMITMENT TO PSVBC VOLLEYBALL
A. Parents agree that a player’s primary commitment is to his/her team. It is strongly recommended that players do not play on multiple travel teams (multiple sports). Exceptions may be made for players whose ability limits their opportunities within our travel program. If we are not your child’s primary commitment, playing time may be significantly reduced to accommodate players who are more committed to the sport and the team's success.
5. ATTITUDE
A. Parents agree that “Attitude” matters. Player use of foul or abusive language, is strictly prohibited. Behavior, that can be perceived as menacing, hostile, or threatening, towards club administrators, opposing players, teammates, coaches, referees, line judges, or any Parents will result in suspension or expulsion from PSVBC programs.
B. Parents agree that players must be respectful & willing to be “coached”. Disrespect towards Coaches and staff will result in restriction of playing time, suspension, or expulsion from the Potomac Storm Volleyball Club's travel programs.
6. CONDUCT VIOLATIONS & SOCIAL MEDIA
A. Neither Parents, players, or coaches shall behave in a manner that can be reasonably perceived as hostile, intimidating, threatening, or menacing towards Parents, players, or PSVBC staff. Any Parents, players, or coaches who are found to have violated this rule, as determined solely by PSVBC, will be asked to immediately leave the facility & may be permanently banned from PSVBC.
B. Parents and players agree not to use foul language or make rude gestures towards other players, Parents, coaches, officials, staff, or opponents.
C. Parents & players agree not to post (on any platform) negative comments regarding PSVBC staff, players, parents, volunteers, or the Potomac Storm Volleyball Club. Violations of this PSVBC policy can result in an expulsion from PSVBC programs.
7. MEDIA LICENSE
A. Parents and players agree that, as a requirement to participate in PSVBC programs, Parents freely provide PSVBC with a media license to photograph, video record, and disseminate images and video of players and parents, in the course of marketing and promoting PSVBC programs.
8. INSURANCE
A. Travel Volleyball is an expensive undertaking. PSVBC allows payments plans. Team budgets are based on the number of dues paying players, on the team. The dues are necessary to maintain the program and NOT refundable by PSVBC. Parents can insure themselves against a loss of paid club dues, in case of a season ending illness, injury, job loss, etc., by purchasing an insurance plan. B. Unless cleared by PSVBC, Parents are not permitted to enter upon the volleyball court at practices and/or tournaments. This is due to insurance requirements as well as Safesport Rules and the Safesport Act.
9. LIMITATION OF LIABILITY
A. Parents agree that PSVBC is organized for the purpose of providing the area youth with an opportunity to learn a competitive sport, learn teamwork, build relationships, maintain good health, and provide a positive competitive outlet that could result in a sports scholarship that furthers their education. Parents agree that PSVBC shall have no liability, with respect to the Parents and/or Players, and hereby agree to hold PSVBC harmless in respect of any claim for any indirect, incidental, consequential, special, punitive, direct, or other damages suffered or incurred by the Parents in connection with any action or omission, on the part of PSVBC, which may arise, including but not limited to any arising out of, or in any way related to, this Agreement, including for any performance or non-performance of any provision, portion, representation, warranty, or transaction related to or contemplated by this Agreement. Should any court of competent jurisdiction void or hold unenforceable the Parents release of liability, then Parents agree that the maximum liability of PSVBC, to the Parents, shall be that pro-rated portion of club dues, for any remaining volleyball practices, of the total of 36 practices, that Parents did not receive. Parents agree that under no theory of law, either known or unknown, shall PSVBC be liable for any amount exceeding the amount paid, by the Parents, to PSVBC. Parents agree that PSVBC shall not be liable, to Parents, for any legal fees, court costs, medical expenses, experts fees, civil judgments including but not limited to any punitive judgments, arbitration expenses, rulings, or costs, or any other costs or fees, whatsoever, under any theory of law, known or unknown, related to this Agreement, arising out of or in connection with this Agreement, or the performance thereof, however caused, or any liability whether such liability is based on breach of contract, tort, strict liability, breach of warranties, failure of essential purpose, or otherwise.
10. OPEN DOOR POLICY
A. PSVBC is dedicated to maintaining an open-door policy, with respect to Parents.
11. PARENTS/PLAYERS USE OF FACILITY
A. It is the intention of PSVBC to permit, as much as scheduling allows, Parents and players participating in the PSVBC volleyball program, to use the facility for such functions as to PSVBC's directors seems reasonable. Under no circumstances will minors have use of the facility without the presence of a responsible adult. Parents requesting use of the facility, for any event, assume all liability for any damages to the facility as well as damages to or theft of PSVBC property. Parents wishing to use the facility should submit an email to [email protected], detailing the event planned, the time and date of the event, the number of people who will be present, and which person will be responsible. The PSVBC directors will review all such requests against the schedule of official events, and contact the Parents requesting to use the facility.
B. It is the intention of PSVBC that all official club meetings will take place at the facility.
12. REPORT PROCEDURE
A. If Parents and/or Players want to file a complaint regarding an allegation of abuse/harassment (verbal or otherwise) against any PSVBC parent, player, or staff member, the Parents and/or Players should request a PRIVATE CHAT with the CLUB DIRECTOR, on the TeamApp.
B. If the issue is NOT involving an allegation of abuse/harassment, the Parents and/or Players should follow these resolution steps,
(1) Players discuss the matter with their Coach before or after practice. If issue is not resolved
(2) Parents submit written statement of issue & desired outcome to any Board Member.
(3) Board of Directors will review information, with Club Director, & make a FINAL decision.
13. PSVBC PLAYING TIME POLICY
A. PSVBC has determined that players with the BEST STATS, in each position, shall be the starting tournament player (in that position) and shall have earned tournament playing time. As the season progresses, one player's stats may earn them the starting position/playing time over another player who previously was performing at a higher level. The goal of competing, in travel volleyball practice, is to train players to play at a higher skill level. The goal of competing, at travel volleyball tournaments, is to give the team the best statistical chance of winning. That is accomplished by playing the most skilled players. This policy is enforced by the PSVBC Club Director & Club Statistician, and is supervised by the PSVBC President & Board.
14. SEVERABILITY CLAUSE
A. If any court, of competent jurisdiction, shall determine that any provision, representation, or warranty of this Agreement is invalid, void, or unenforceable, the remainder of the provisions, representations, and warranties shall continue in full force and effect, without regard to the invalid portion(s).
15. RELEASE OF LIABILITY FOR PARTICIPANTS
A. Parents and Players agree to the terms and conditions of the RELEASE OF LIABILITY FOR USE OF FACILITY AND/OR EQUIPMENT, attached hereto, and that the same document shall be incorporated into this agreement.
16. ADDITIONAL POLICIES
A. Parents agree and understand that PSVBC has additional policies, rules, requirements, terms, & conditions, which are posted on the https://www.potomacstorm.com website, and that the same may be amended by the Board of Directors of PSVBC, without notice. Parents agree to abide by any such policies, rules, requirements, terms, & conditions, when posted on the https://www.potomacstorm.com website, in addition to the rules outlined in this contract document, and that if there is any contradiction between the terms and conditions of this Agreement and any policies posted to the club's website, the newer policy shall prevail, and continue in full force and effect, and shall be considered as an agreed upon amendment to this Agreement.
I. Coaches, Parents, and Players agree and understand that they shall NOT enter into discussions (including through verbal, written, or any electronic means, including but not limited to email, text, Team App, and/or any social platform) with any person, firm, corporation, partnership, or other entity, whatsoever, where such discussions involve Potomac Storm Volleyball Club's players, parents, members, staff, and/or coaches joining any other existing or planned volleyball team, club, or organization, during the term of the PSVBC Parent/Player Agreement, Coaching Agreement, and/or season. Parents, players, and coaches who are determined to have violated this policy, such determination to be made solely by the President of Panhandle Youth Volleyball Association Incorporated dba Potomac Storm Volleyball Club (PSVBC), shall be subject to immediate expulsion from PSVBC and in such cases, the Parents and Players agree that all payments made to PSVBC shall be forfeited to the PSVBC.
II. Coaches, Parents, and Players agree and understand that they shall NOT threaten, denigrate, insult, present false accusations against (accusations which cannot be evidenced by means other than the claims of one person), or demean Potomac Storm Volleyball Club and/or it's coaches, players, parents, or staff, (whether such comments are verbal, written, or transmitted via any electronic means, including but not limited to email, text, and/or any social platform, including TeamApp), and further agree that such action shall justify immediate removal of the offending Coach or Parent(s) and their Player(s) from the PSVBC programs and it is understood that all payments made by the said Parent(s) and their Player(s) shall be forfeited to PSVBC.
III. Coaches, Parents, and Players agree and understand that comments of a profane and/or vulgar nature, whether such comments are verbal, written, or transmitted via any electronic means, including but not limited to email, text, and/or any social platform, including TeamApp, and which are directed at/to PSVBC staff, players, or parents, ESPECIALLY comments regarding human sexual reproductive organs, are understood to be harassment and/or sexual harassment and shall be understood to justify immediate removal of the offending Coach or Parents(s) and their Player(s) from the PSVBC programs and it is understood that all payments made by the said Parent(s) and their Player(s) shall be forfeited to PSVBC.
IV. Coaches, Parents, and Players agree and understand that Players shall NOT miss practices, except in cases of illness or emergencies, as doing so affects the entire team. Players who miss a team practice, without the absence being excused by the Head Coach (copied to the Potomac Storm Volleyball Club President), shall NOT play in the first set of the next tournament. If a player has 2 consecutive unexcused absences from practice, the Head Coach shall notify the PSVBC Club Director and the player shall NOT participate in the next tournament. If a player has 3 consecutive unexcused absences from practice, the Head Coach shall notify the Club Director and the player shall be removed from the PSVBC programs, forfeiting all amounts paid to PSVBC. As preparation for Nationals is vital, ANY unexcused absence from practices held between the last regular season tournament and AAU or USAV Nationals shall result in the player being removed from the team. It is understood that all payments made by the said Parent(s) and their Player(s) shall be forfeited to PSVBC.
V. Coaches, Parents, and Players agree and understand that if they are determined, by the President of Potomac Storm Volleyball Club, to have demeaned any volleyball club, any volleyball club's facilities, or any volleyball club's staff, regardless of whether such comments are verbal, written, or transmitted via any electronic means, including but not limited to email, text, and/or any social platform, including TeamApp, then the Coach(s), Parent(s) and their Player(s) shall be understood to have voluntarily quit the PSVBC program and forfeited all amounts paid to PSVBC.
VI. Coaches, Parents and Players agree and understand that exposure to the Coronavirus can cause severe illness, result in cancelled practices and tournaments, require expensive and time consuming closure and sanitizing of the Potomac Storm Volleyball Club gym, and result in financial harm to the Potomac Storm Volleyball Club, and as such the Potomac Storm Volleyball Club has enacted COVID specific rules, which include closing Potomac Storm Volleyball Club's gym to parents, UNLESS during specific events where advance written notice is provided that parents shall be allowed to enter therein OR on occasions where any parent(s) are requested to enter for the purpose of a meeting with club staff. Any parent witnessed, by Potomac Storm Volleyball Club's staff, entering the Potomac Storm Volleyball Club's gym without written permission and/or entering without a properly worn mask ( if face masks are deemed required by health officials or PSVBC's President ), shall be understood to have willfully endangered the Potomac Storm Volleyball Club's staff and players, and the offending Parent(s) and their Player(s) shall be understood to have voluntarily quit the PSVBC program and forfeited all amounts paid to PSVBC.
VII. Coaches, Parents, and Players agree and understand that PSVBC has designated certain staff, including volunteers, to perform certain duties for each team. These staff members include the Head Coach, Assistant Coach, Team Mom/Dad, Director of Coaches, Assistant Club Director(s), Club Director(s), and Executive Administrative Staff. Their duties are:
(a) The Club Executive Director (President) shall oversee every facet of the volleyball program. ONLY the Club Director shall make decisions regarding PSVBC jerseys and spirit wear.
(b) The Club Directors shall provide assistance, as needed, to the Club Executive Director.
(c) The Fundraising Coordinator shall assist with all fundraising activities and coordinate with the Team Mom/Dad's under the direction of the Club Director(s).
(d) Director of Coaches: the Director of Coaches shall supervise Head Coaches, under the direction of the Executive Director.
(e) On the TEAM Level, PSVBC Coaches agree and understand that Head Coaches duties are limited to involvement the following:
- Plan and coach practices and scrimmages.
- Implement drills to improve each player's health and conditioning
- Create strategies to lead the team to victory in tournaments.
- Provide feedback and coach during tournaments.
- Maintain player and team stats and attendance records (copied to the Club President).
- Recruit new athletes for the team/club in accordance with PSVBC, CHRVA, USA Volleyball, and AAU guidelines for recruiting.
- Mentor & motivate players to improve their volleyball skills, display sportsmanship, and learn volleyball rules and strategies.
- Maintain the equipment and facilities to ensure safe playing conditions and that Club owned equipment is not damaged or improperly used (Coaches shall be financially liable to PSVBC for any Club property damaged during their practices - normal wear and tear excepted).
- Enforce safety procedures and Club rules.
- Insure that Safesport guidelines are followed - There shall be NO PRIVATE MEETINGS OR COMMUNICATIONS BETWEEN ANY COACH AND PLAYER and NO DISCUSSIONS/INTERACTIONS OF A SEXUAL NATURE.
- Adhere to all guidelines within the newest edition of the USA Volleyball Coaches Code of Ethics and Conduct, the newest edition of the Code of the Amateur Athletic Union, and the current rules and policies of the Potomac Storm Volleyball Club
- Potomac Storm VBC coaches and parents agree and understand that any VIDEOTAPING and/or LIVESTREAMING of any Potomac Storm Volleyball Club team practice or tournament, with the exception of the team's coaches, shall only be done with the permission of the team's head coach and written permission of the Potomac Storm VBC President. Any such recording or livestreaming shall be shared ONLY on the PSVBC team's approved Face Book page, which shall have the PSVBC President as an Admin. Under no circumstances is a parent or coach to share any such videotape or livestream with a staff member or parent of any other travel volleyball club as such video can be used to better prepare a competing team to play the PSVBC team, in a future tournament. Violations of this policy will result in the offending coach(s) or parent(s) and their players being suspended from participating with PSVBC, for 2 weeks.
(f) The Assistant Coaches shall assist the Head Coach in the performance of their outlined duties.
(g) TEAM MOM/DAD - Team Moms/Dads are ONLY designated by the Executive Director and act on behalf of the Club's Executive Administration. This volunteer position is selected by and reports to the Executive Director, in order to prevent the appearance of nepotism on the team level. The position of Team Mom/Dad is open to ANY parent/guardian that wishes to apply for the role. Team Coaches have no involvement in the process of selecting, supervising, or performing the duties of the Team Mom/Dad.
The Team Mom/Dad has SOLE authority, with the approval of the Executive Director, to:
1. Select, arrange, and communicate Potomac Storm VBC Team Bonding events and Tournament Hotel Blocks
2. Work with the PSVBC Fundraising Coordinator on Team based Fundraising events
3. Arrange ANY PSVBC Team Function other than those related to Practices and Coaching at Tournaments
ANY INTERFEREANCE IN THE ADMINISTRATION OF PSVBC PROGRAMS, BY ANY COACH, PARENT, OR PLAYER SHALL BE UNDERSTOOD TO BE GROUNDS FOR IMMEDIATE REMOVAL FROM ALL PSVBC PROGRAMS AND FORFEITURE OF ALL AMOUNTS PAID TO PSVBC.
(h) TEAM APP - Coaches, Parents, and Players agree and understand that TeamApp is the mandatory communication platform for any Potomac Storm Volleyball Club team/club related discussions. ANY INTERFEREANCE IN THE ADMINISTRATION OF PSVBC PROGRAMS, BY ANY COACH, PARENT, OR PLAYER SHALL BE UNDERSTOOD TO BE GROUNDS FOR IMMEDIATE REMOVAL FROM ALL PSVBC PROGRAMS AND FORFEITURE OF ALL AMOUNTS PAID TO PSVBC.
(i) Coaches, Parents, and Players agree and understand that any person who has interfered in the duties designated to any member of the Potomac Storm Volleyball Club staff, shall be provided a verbal warning, by any appropriate staff member. The verbal warning shall be reported to the PSVBC Executive Director. Any 2nd occurrence shall result in a documented meeting with a PSVBC Assistant Club Director or other designated staff member. Action seeming appropriate to the staff member(s) shall be taken at the time of the said meeting, up to and including removal of the offending party(s) from PSVBC. Any 3rd occurrence shall result in the offending party(s) having been considered as habitually refusing to follow the rules and policies of the Potomac Storm Volleyball Club (PSVBC) and any such offending Coaches, Parent(s), and/or Player(s) shall be understood to have voluntarily quit the Potomac Storm Volleyball Club program and forfeited all amounts paid to PSVBC. In the event that it is revealed that any person(s) has/have previously committed multiple prior violations of PSVBC policy, then the offending party(s) may be immediately determined to have habitually violated the policies of PSVBC and shall be understood to have voluntarily quit the PSVBC volleyball program and forfeited any amounts paid to PSVBC. ANY INTERFEREANCE IN THE ADMINISTRATION OF PSVBC PROGRAMS, BY ANY COACH, PARENT, OR PLAYER SHALL BE UNDERSTOOD TO BE GROUNDS FOR IMMEDIATE REMOVAL FROM ALL PSVBC PROGRAMS AND FORFEITURE OF ALL AMOUNTS PAID TO PSVBC.
(j) PSVBC Staff, Volunteers, Coaches, Parents, and Players agree and understand that any information, documents (including but not limited to invoices, leases, purchase orders, proposals, plans, procedures, processes, member lists, contact information for any business related customer, intellectual property, and/or work product), objects, and other property, of any kind or nature whatsoever, whether tangible or electronic, including but not limited to information which may be communicated by and between any PSVBC staff member(s) and/or any third party(s), especially information which is clearly intended for PSVBC staff members only, is the sole property of PSVBC and shall be considered as private and confidential information, proprietary information, trade secrets, and specialized industry know how.
Dissemination of any such information or documents, without the express written permission of the PSVBC Executive Director (President), shall be understood to constitute interference in the business of PSVBC, theft of company property, and corporate espionage. This shall occur whenever, in the sole determination of the PSVBC Executive Director (President), any PSVBC Volunteer, PSVBC Staff member(s), PSVBC Coach(s), PSVBC Parent(s), or PSVBC Player(s) shall reveal, transmit, communicate, or divulge, by any means, information regarding PSVBC vendors, invoices, leases, member lists, documents, records, files and/or information, including but not limited to any personal or business information of any kind or nature whatsoever. Any dissemination of such protected and confidential information or documents by any means, including but not limited to electronic, tangible, and verbal dissemination of the same, shall constitute a GROSS VIOLATION of PSVBC policy and shall result in immediate dismissal of the PSVBC staff member(s), coach(s), and/or Parent(s) and their respective Player(s) from any future involvement in PSVBC, and shall result in forfeiture of all amounts paid to PSVBC, by the parent and/or player.
PERSONS REVEALING PSVBC EMAILS, OR OTHER PROTECTED INFORMATION, TO ANY UNAUTHORIZED PERSON, ENTITY, OR CORPORATION SHALL BE CONSIDERED IN VIOLATION OF ALL APPLICABLE STATE AND FEDERAL LAWS, when they knowingly or recklessly, without the consent of the data controller (PSVBC), obtain or disclose personal data (or the information contained in personal data) or procure the disclosure to another person of the information contained in personal data.
VIII. Coaches, Parents, and Players agree and understand that they shall not make false accusations against any named parent(s)s, player(s), or staff member(s), on/by any medium, including but not limited to accusation communicated verbally, via written form, via any electronic means, via any social media platform(s), and/or via TeamApp.
Accusations shall be considered as false when they are found to be unsupported by documented evidence. In such instances as accusations are levied against any specifically named parent(s), grandparent(s), player(s), or staff member(s) of PSVBC, without supporting documentation evidencing the event or issue at question, the claims of the accuser shall be deemed as baseless.
If the accused or any reliable 3rd party agency shall provide DOCUMENTED evidence, a preponderance of which is found to support the innocence of the accused, with regard to the aforementioned accusations made against them, the accusing party(s) shall be considered as harassing the named person(s). As Potomac Storm Volleyball Club (PSVBC) has a ZERO BULLYING POLICY, the person(s) who are determined to have made the false accusations shall be removed from any involvement in the Potomac Storm Volleyball Club (PSVBC), immediately, and the offending Parent(s) and their Player(s) shall be understood to have voluntarily quit the PSVBC program and forfeited all amounts paid to PSVBC.
IX. Coaches, Parents, and Players agree and understand that any person against whom a protective order is in effect, pursuant to the provisions of West Virginia Code §61-2-9a(a), §61-2-9a(b), or any other similar statute, who has been served with a copy of said order, shall be removed from any involvement in the Potomac Storm Volleyball Club, immediately, and the offending Coach(s) or Parent(s) and their Player(s) shall be understood to have voluntarily quit the Potomac Storm Volleyball Club program and forfeited all amounts paid to the Potomac Storm Volleyball Club (PSVBC).
Potomac Storm Volleyball Club (PSVBC) will take reasonable steps to enforce all restrictions outlined within the said order, including denying the said person(s) entry upon the property of and/or within the confines of any facilities owned, leased, utilized, and/or controlled by Potomac Storm Volleyball Club (PSVBC). Such orders will also be presented to USAV, AAU, JVA, and to EVERY Tournament Director overseeing tournaments where the protected participant would be competing or training.
X. Additional Practices: Coaches, Parents, and Players agree and understand that PSVBC's facilities and equipment are intended for use by PSVBC players and/or teams, which are current on payment of team/club dues/fees, during the course of the regular travel season. As PSVBC schedules events for other groups, after the end of the regular travel season, PSVBC must restrict use of the Club's facilities and equipment when the regular season concludes. At the sole discretion of the PSVBC Executive Director, PSVBC may provide volleyball practices in addition to a PSVBC team's 36 guaranteed travel volleyball season practices. The Executive Director shall consider providing additional practices ONLY when a PSVBC player(s) and/or team(s) have timely completed all financial obligations to PSVBC, in accordance with the fee amounts and by the due dates listed in the season's REQUIREMENTS TO PLAY tab on www.potomacstorm.com, and are fully compliant with all PSVBC policies. Under no circumstances shall PSVBC be understood to be obligated to provide any coach(s), practices, services, equipment, and/or tournaments to/for any PSVBC Parent, Player, and/or team where the Parent, Player, and/or team have failed to timely complete all financial obligations to PSVBC, in accordance with the fee amounts and by the due dates listed in the season's REQUIREMENTS TO PLAY tab on www.potomacstorm.com, and/or where the Parent(s), Player(s), or team are not fully compliant with all current PSVBC policies.
The PSVBC Gym, and any other PSVBC leased facility, are CLOSED to non-staff members. Exceptions may be made at the sole discretion of the Executive Director of PSVBC.
XI. Authority to Enter: Coaches, Parents, and Players agree and understand that PSVBC is a private youth sports club. Parents, Players, and Coaches shall NOT enter the PSVBC Gym or any PSVBC leased facility, if they are not currently in season, have exceeded their PSVBC team's guaranteed 36 travel volleyball season practices, are NOT CURRENT in payment of any amounts owed to PSVBC, are in violation of any PSVBC policy, and/or are entering at a time NOT designated, by the PSVBC Executive Director, as being a time designated for one of their PSVBC team's 36 travel volleyball season's scheduled practice. The PSVBC Executive Director has designated that Players shall not enter a PSVBC training facility sooner than 15 minutes prior to their PSVBC team's scheduled practice time. Persons who are not authorized to enter the Potomac Storm Gym, located at 64 Dupont Rd., Martinsburg, West Virginia, including the areas designated for parking, are trespassing and subject to be removed by law enforcement.
XII. Donations Accepted/Fundraised:
(a) Coaches, Parents, and Players agree and understand that amounts donated/fundraised, under the name of PSVBC and/or a PSVBC team, are understood to be the sole property of PSVBC. Donations accepted/fundraised, under the name of PSVBC and/or a PSVBC team, are NOT refundable.
(b) If any Coach and/or Player fails to participate in a volleyball tournament, where donations made in the name of PSVBC or any PSVBC team(s) would have been allocated to reimburse participants for costs incurred as a result of their participation, the non-participating Coach and/or Player shall receive no portion of any amounts donated/fundraised. If an entire PSVBC team does not participate in any such tournament, no Coach or Player shall receive any portion of any amounts donated/fundraised for the said tournament. In such instances, donations accepted/fundraised, may be used for an alternate regular season tournament for the said PSVBC team, if the team's current regular volleyball season has not ended. In instances where any such PSVBC team's season has concluded but other PSVBC teams are still competing, the donated/fundraised funds may be used for reimbursing expenses of another PSVBC team that does participate in the same or another tournament. In the event that the season has concluded for all other PSVBC teams, the donations accepted/fundraised shall be used for other PSVBC expenses.
(c) In instances where donations are made/fundraised in the name of PSVBC or a PSVBC team, the Team Mom (designated by the PSVBC President) or the Club team's Head Coach (when a Team Mom has not been designated, by the PSVBC President, or has resigned from the Club), shall be responsible for following PSVBC policy regarding submitting donations to PSVBC. If the designated Team Mom, or team's Head Coach, when the designated Team Mom has resigned from PSVBC, fail to follow any PSVBC policy and/or fail to submit any amounts donated/fundraised to PSVBC, the Team Mom and/or Team Coach shall waive their right to any reimbursement amounts owed to them, by the PSVBC.
XIII. Use of Facilities and Equipment:
(a) Coaches, Parents, and Players agree and understand that PSVBC facilities and equipment are the sole property of PSVBC, that each PSVBC team's Head Coach is provided with a volleyball bag, a Tachikara volleyball cart & carrying case, and Tachikara volleyballs equal to the number of original players on the team plus one additional ball. The said equipment is understood to have a replacement value of $950.00. The PSVBC team's Head Coach is responsible to return, to PSVBC, the issued equipment, as indicated above, as well as for any additional PSVBC equipment and/or property that PSVBC can evidence was taken and/or damaged by the said PSVBC Coach(s) or the PSVBC team that they Coach. In instances where a PSVBC Coach(s) have no written receipt evidencing the return and/or replacement of all PSVBC equipment, said receipt to be signed and dated by the PSVBC Executive Director, the PSVBC Coach(s) shall be responsible for fully reimbursing PSVBC for the replacement cost thereof. Any trophies won by any PSVBC team, during either the PSVBC team's regular volleyball season and at the USAV, AAU, and/or JVA Junior Girls National Volleyball Championship Tournament(s), are understood to be the sole property of PSVBC and must be surrendered, by the PSVBC team's Coach(s), to PSVBC, within 10 days of the PSVBC team winning the trophy.
PSVBC Coaches shall receive NO REIMBURSEMENT from PSVBC until such time as they can prove they have surrendered to PSVBC (a) ALL PSVBC equipment provided to or taken by the PSVBC team coached by them, (b) any tournament trophies won by the PSVBC team coached by them, (c) full payment to PSVBC for any damages which were caused by the PSVBC team's Coach. Damages, as used herein, include but are not limited to sanctions levied on PSVBC by licensing bodies as a result of any action/inactions on the part of the PSVBC team's Head Coach, fines or fees levied on PSVBC as a result of any action/inaction on the part of the PSVBC team's Head Coach by event promoters or facility owners/lessees, actual damages to PSVBC leased premises and/or equipment, and actual replacement costs of any PSVBC owned equipment issued to, or removed from, any PSVBC leased or owned facility.
(b) Except in instances where a PSVBC team has either entered the USAV, AAU, and/or JVA Junior Girls National Volleyball Championship Tournament as part of their PSVBC team's budgeted tournament days, or won a regular season volleyball tournament which awards the winning team with a paid entry into the USAV or AAU Junior Girls National Volleyball Championship Tournament(s), PSVBC's obligation to provide equipment, facilities, or any other assistance to the PSVBC Coaches, Parents, and Players shall end upon the team's completion of the last regular season tournament. Parents/Players that have not paid ALL Team/Club dues/fees by March 1st of their season, shall be understood to have waived any right to continue their travel volleyball season with PSVBC, and at the sole determination of the PSVBC Executive Director, shall be removed from all future practices and tournaments. If PSVBC is required to take any action(s), including but not limited to invoicing, assigning for debt collection, or any action involving legal counsel, in order to pursue collection of any amounts owed to PSVBC, Parents shall be responsible for any costs incurred as a result of those collection efforts, including but not limited to a $200 administrative fee, any amounts charged by third party collection agencies, and all legal costs incurred, including but not limited to reasonable attorney's fees, court costs, and other such related expenses. PSVBC shall have the right to decline late payments and/or partial payments, at the sole discretion of the Executive Director, and such action on the part of the PSVBC Executive Director shall not remedy any amounts owed by Parents.
(c) Coaches, Parents, or Players on any PSVBC team that did not meet the requirements for post-season play in a National Volleyball Championship Tournament, as described herein, after the team's completion of their last regular season tournament, shall have no right to use any facilities or equipment leased or owned by PSVBC. If any Coaches, Parents, or Players wish to use any PSVBC facilities, they shall make a written request to PSVBC. Any such PSVBC gym reservation request is understood to be billed at a rate of $50.00 per court hour, with a 2 hour minimum, and payment for the same shall be the responsibility of the team's Coach. PSVBC equipment is not included in any court rental. Any such team(s) making use of the gym shall inform PSVBC, shall be responsible for the costs of any requested gym time, shall provide their own equipment, and shall be liable for any damages to PSVBC leased or owned property.
17. FUNDRAISING
A. All fund-raising must be approved by PSVBC, and supervised by a Fund-Raising Director/Coordinator, appointed by PSVBC, in order to ensure full compliance with state and federal regulations. Once a fund-raising plan has been approved in writing, and held, funds must be submitted to PSVBC within 24 hours, to insure an accurate tax filing. The funds will be earmarked for the team that raised them and used for allowed expenditures for that team. ALL teams are expected to participate in club wide fundraisers, which benefit every team & player. Parents who do not submit fund raising moneys, within 24 hours, shall be suspended from PSVBC (unless arrangements are made) until the funds are remitted. Under no circumstances shall parents or players use the name Potomac Storm Volleyball, or PSVBC, to raise funds without the written authorization of PSVBC, which may be withdrawn at any time, without prior notice.
Under no circumstances shall any 3rd party be led to believe that a fundraiser, not pre-approved by PSVBC (in writing), constitutes a donation to PSVBC.
No letterhead or other representation, which indicates that it originated with or through Potomac Storm Volleyball and/or PSVBC, or which displays any emblem, proprietary, or intellectual property of PSVBC, shall be created or disseminated to any 3rd party by any person other than PSVBC, regardless of whether such letterhead or similar representation is sent and/or delivered by USPS, FedEx, UPS, DHL, by any other party (whether paid or unpaid), or by electronic means.
18. REFUNDS POLICY
A. Travel Volleyball is an expensive undertaking. PSVBC allows payments plans. Team budgets are based on the number of dues paying players, on the team. The dues are necessary to maintain the program and NOT refundable by PSVBC, regardless of any verbal or written claim indicating otherwise.
19. ENTIRE AGREEMENT
A. This Agreement, together with all other documents incorporated or referred to herein, including the ADDITIONAL POLICIES, referenced under section 16(A), and the incorporated RELEASE OF LIABILITY FOR PARTICIPANTS, referenced under section 15(A), supersede all understandings and constitute the entire agreement existing between the parties respecting the subject matter of this Agreement, and neither party shall be entitled to any benefits other than as specified. PARENTS AGREE that they have read this Agreement, fully understand it's terms and conditions and how it affects their rights and HAVE INITIALED AND/OR SIGNED ALL PAGES OF THIS AGREEMENT, as well as the incorporated RELEASE OF LIABILITY FOR PARTICIPANTS.
IN WITNESS WHEREOF, the undersigned have executed this Agreement freely and voluntarily, without any inducement, and on the date indicated below.
